Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Empikalyze platform, including its AI-powered resume screening services (collectively, the "Service"), operated by Empikalyze ("Empikalyze," "we," "us," or "our").

By accessing or using the Service, you ("Customer," "you," or "your") confirm that you are authorized to bind your Organization to these Terms, and you agree to be bound by them on behalf of your Organization. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility & Accounts

The Service is intended exclusively for business users, including HR professionals, recruiters, staffing firms, and recruitment agencies acting on behalf of an Organization.

The Service is not designed for, or intended to be used by, consumers for personal job search or any non-commercial purpose.

Access to the Service is provisioned at the Organization level. The individual who creates or administers an Organization account is responsible for all activity conducted under that account, including purchases made, Resume Processing Credits consumed, and the conduct of all recruiters and users invited to the Organization.

3. Acceptable Use

You agree to use Empikalyze only for lawful and legitimate recruitment purposes. The following activities are explicitly forbidden:

  • Uploading illegal, harmful, defamatory, or non-consensual personal data
  • Using resumes or candidate information without proper authorization from the candidate
  • Attempting to reverse engineer, extract, or reproduce our AI models
  • Scraping, automated bulk uploading, or abusing the platform in ways that degrade service for others
  • Violating any applicable data protection or employment laws

We reserve the right to suspend or terminate accounts that violate these Terms.

4. AI Limitations Disclaimer

Empikalyze provides assistive insights to help recruiters make informed decisions.

Empikalyze does not guarantee hiring outcomes. AI suggestions are based on patterns in resume data and should be used as one input among many in your hiring process.

Final hiring decisions remain with you and are your responsibility alone. Empikalyze is not responsible for employment decisions made based on our platform's output.

5. Resume Processing Credits

Empikalyze operates on a Usage-Based Billing model. Access to AI-powered Resume Screening is enabled through Resume Processing Credits, which represent prepaid processing capacity purchased by your Organization.

The following consumption rules apply to Resume Processing Credits:

  • One AI-processed resume consumes one (1) Resume Processing Credit. Credits are drawn from your Organization's Available Credits at the time a resume is successfully processed.
  • Viewing screening results, revisiting previous screening sessions, or reopening historical candidate analyses does not consume additional Resume Processing Credits.
  • Only resumes that are successfully processed consume Resume Processing Credits. Resumes that fail due to unsupported file formats, corrupted content, or unreadable text are flagged for retry and do not reduce Available Credits. Retrying failed resumes is provided at no additional cost.
  • All recruiters and users within the same Organization draw from a single, shared pool of Available Credits. Empikalyze does not charge per seat, per recruiter, or per job posting.

The current per-credit rate, applicable volume discounts, and full pricing details are published at empikalyze.in/#pricing and within the in-app Pricing page. Empikalyze reserves the right to update pricing for future purchases; any change applies only to Resume Processing Credits purchased after the change takes effect and does not alter the rate or availability of Previously Purchased Credits.

6. Usage-Based Billing & Pricing Duration

Empikalyze uses Usage-Based Billing. You purchase a discrete quantity of Resume Processing Credits and consume them as Resume Screening is performed. There is no recurring subscription, no automatic renewal, and no per-seat charge.

When purchasing Resume Processing Credits, the pricing calculator allows you to select a Pricing Duration of 1, 3, 6, 12, or 24 months. The selected Pricing Duration:

  • is used solely for pricing calculations;
  • may qualify your Organization for discounted pricing based on anticipated hiring volume; and
  • assists in estimating the expected processing volume for your Organization.

Selecting a longer Pricing Duration constitutes a pricing commitment. It is used exclusively to calculate the applicable per-credit rate and any volume discount. It is not a subscription period, and it does not impose an expiration date, validity window, or usage deadline on any Purchased Credits.

Volume discounts are applied at checkout based on the selected Pricing Duration and are reflected in the per-credit rate for that purchase. Discounted rates do not apply retroactively to Previously Purchased Credits.

7. No Expiry of Purchased Credits

Purchased Resume Processing Credits do not expire. Unused credits remain available on your Organization account until they are consumed by Resume Screening.

There is no automatic expiration of Purchased Credits based on the selected Pricing Duration. The expiration of a Pricing Duration does not, under any circumstance, cause Purchased Credits to lapse, be forfeited, or be removed from your Organization's Available Credits.

8. Credit Exhaustion & Additional Purchases

If your Organization consumes all Available Resume Processing Credits before the selected Pricing Duration has elapsed, the following applies:

  • Resume Screening will be suspended until additional Resume Processing Credits are purchased.
  • Your Organization may purchase additional Resume Processing Credits at any time, in any supported quantity, through the in-app Pricing page.
  • Newly Purchased Credits are added to your Organization's Available Credits balance.
  • Purchasing additional Resume Processing Credits does not invalidate any previously purchased unused credits. If any Previously Purchased Credits remain, they continue to be available and are consumed alongside newly Purchased Credits.

9. Partial Credit Usage

If only part of the purchased quota has been consumed, the remaining Available Credits continue to remain available and are not affected by the passage of the Pricing Duration.

Example: An Organization purchases 2,000 Resume Processing Credits. After several months, only 900 credits have been consumed through Resume Screening. The remaining 1,100 credits continue to remain available on the Organization account. Those remaining credits do not expire simply because the originally selected Pricing Duration has elapsed.

10. Product Availability

Customers retain access to the Empikalyze platform in accordance with their account status. However, AI-powered Resume Screening requires Available Resume Processing Credits.

If your Organization's Available Credits balance reaches zero:

  • New Resume Screening cannot be initiated until additional Resume Processing Credits are purchased.
  • Existing screening results remain accessible for review, export, and reference.
  • All historical data, including candidate analyses and screening sessions, is preserved.
  • Purchasing additional Resume Processing Credits immediately restores the ability to initiate new Resume Screening.

11. Service Availability

Empikalyze is provided on an "as-is" and "as-available" basis. We do not currently guarantee specific uptime percentages or provide service level agreements (SLAs) for the Service.

Occasional downtime may occur for scheduled maintenance, feature updates, infrastructure changes, or bug fixes. We strive to minimize disruption but cannot guarantee continuous, uninterrupted availability.

Features and functionality may be added, modified, or deprecated as we continue to improve the platform. Material changes affecting billing or Resume Processing Credits will be communicated in advance where reasonably possible.

12. Liability Limitation

Empikalyze accepts no responsibility for hiring decisions made by users based on platform outputs. The Service is informational and assistive only.

To the maximum extent permitted by law, Empikalyze is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India.

The English language version of these Terms shall govern any interpretation, and any translations are provided for convenience only.
